Please read these Terms and Conditions carefully before purchasing or using MobiGron products and services.

1. Introduction

Welcome to MobiGron. We provide smart agriculture products and services that help customers monitor and manage agricultural activities through connected equipment and a mobile application. Our products may include Hydroponic Automation Systems, Dryer Automation Systems, Irrigation Automation Systems, Soil Monitoring Systems and other agricultural monitoring and automation products.

These Terms and Conditions explain the rules that apply when you purchase, install or use our products, mobile application, website and related services. By purchasing our products, creating an account, using our application or using our services, you agree to these Terms and Conditions. If you do not agree with these terms, you should not use our services.

2. Our Services

Our services are designed to help you monitor and manage agricultural activities. Depending on the products you have purchased, you may be able to monitor information such as temperature, humidity, soil moisture, pH, EC, water level and other agricultural conditions through our application.

Our systems may also allow you to control equipment such as pumps, motors, fans, valves and other connected equipment. Some systems may operate automatically according to settings selected by you.

The exact features available to you will depend on the product you purchase, the equipment installed at your location and the service package you have selected.

3. Hydroponic Automation System

Our Hydroponic Automation System is designed to help you monitor and manage hydroponic growing conditions. Depending on your system, it may allow you to monitor information such as pH, EC, water temperature, water level and other supported conditions.

The system may also allow you to control pumps, nutrient dosing equipment and other equipment connected to the system.

The system is intended to assist with hydroponic management. It does not guarantee a particular crop yield, plant growth rate or agricultural result. Crop results depend on many factors, including plant variety, nutrients, water quality, environmental conditions, temperature, light, pests, diseases and the way the system is operated.

4. Dryer Automation System

Our Dryer Automation System is designed to help customers monitor and manage drying conditions. Depending on the system, you may be able to monitor temperature, humidity and other conditions and control equipment such as fans or other connected equipment.

The system is intended to assist with the drying process. It does not guarantee a specific drying time, moisture level, product quality or final result.

The customer remains responsible for selecting appropriate drying settings and ensuring that the product being dried is suitable for the drying process.

5. Irrigation Automation System

Our Irrigation Automation System is designed to help customers manage irrigation using information such as soil moisture, water level and other available measurements.

Depending on the system, it may automatically operate pumps, motors or valves according to settings selected by the customer.

The customer is responsible for making sure that the irrigation system is correctly installed, that sufficient water is available and that the selected settings are suitable for the crops and location.

Our system is intended to assist with irrigation management and does not guarantee crop growth, water savings or agricultural results.

6. Soil Monitoring System

Our Soil Monitoring System is designed to help customers understand conditions around their crops or agricultural areas.

Depending on the sensors installed, the system may provide information about soil moisture, temperature, pH, EC and other supported measurements.

The information is intended to assist with agricultural decisions. It should not automatically be treated as a professional laboratory analysis or a replacement for professional agricultural advice.

7. Mobile Application

Our mobile application allows customers to view information from their agricultural systems and, where supported, control connected equipment.

The application may allow you to view current and previous measurements, receive notifications, change settings and operate equipment remotely.

The availability of these features depends on your product and service.

You are responsible for using the application carefully and ensuring that only authorized people have access to your account.

8. Account Responsibility

If you create an account with us, you are responsible for keeping your account information secure. You should not share your password or account access with people who are not authorized to use your system.

If you believe someone has accessed your account without permission, you should contact us as soon as possible.

If you are using the system on behalf of a company, farm or organization, you are responsible for ensuring that only authorized users operate the system.

9. Remote Control of Equipment

Some of our products allow you to control agricultural equipment remotely through the application.

For example, you may be able to start or stop a pump, operate a fan, control a valve or change an operating setting.

You are responsible for checking that the equipment is safe to operate before using remote control. You should not use remote control when doing so could create a risk to people, animals, equipment, crops or property.

You should also make sure that the equipment is properly installed and maintained.

10. Automatic Operation

Some of our systems can automatically operate equipment according to settings selected by the customer.

For example, an irrigation system may operate a pump when soil moisture becomes lower than a selected level, or a dryer system may operate a fan when the temperature reaches a selected level.

Automatic operation is provided to assist the customer. You remain responsible for selecting suitable settings and regularly checking the system.

You should not assume that an automatic system will always operate correctly under every circumstance.

11. Customer Responsibility

You are responsible for using our products according to the instructions provided by us.

You are also responsible for ensuring that your agricultural equipment, electrical supply, water supply and surrounding environment are suitable for the system.

You should regularly check your equipment and agricultural conditions. You should not rely entirely on the application or automated system without reasonable supervision.

If you notice unusual behaviour, incorrect readings, equipment damage or another problem, you should stop using the affected equipment where appropriate and contact us or a qualified professional.

12. Installation

Where installation is included in your purchase, we will install the agreed equipment according to the scope of work provided to you.

The customer must provide reasonable access to the installation location and ensure that the location is suitable for installation.

Additional work that is not included in the original agreement may result in additional charges.

If the customer makes changes to the system after installation, or another person changes or modifies the equipment, this may affect our ability to provide support or warranty service.

13. Electrical and Water Safety

Customers must ensure that the electrical supply, water supply, pipes, pumps and other equipment used with our system are suitable and safe.

Our products should not be modified or connected to unsuitable equipment without appropriate approval or professional assistance.

The customer is responsible for maintaining safe conditions around the installed equipment.

Where electrical, plumbing or other specialist work is required outside our agreed scope, the customer may need to arrange a qualified professional.

14. Sensor Readings and Measurements

Our systems provide measurements based on the sensors and equipment installed at your location.

Measurements can sometimes be affected by sensor condition, installation, calibration, environmental conditions, water quality, soil conditions and other factors.

For this reason, we do not guarantee that every measurement will always be completely accurate.

Customers should arrange appropriate inspection, calibration or professional testing where accurate measurements are important for their agricultural operation.

15. Weather Information

Our application may display weather information such as temperature, weather conditions, wind speed, wind direction, humidity, rainfall and forecasts.

This information may be obtained from external weather information providers and may sometimes be delayed, unavailable or inaccurate.

Weather information is provided to help you understand environmental conditions around your agricultural system. It should not be treated as a guaranteed weather forecast or official meteorological information.

You remain responsible for making appropriate agricultural and operational decisions.

16. Location Permission

Our mobile application may ask you to allow location access so that we can provide weather information relevant to your area.

If you allow location access, the application may use your location to display temperature, weather conditions, wind information and other weather information.

You may disable location access through your mobile device settings. If you disable it, some weather-related features may not work automatically.

17. Internet and Mobile Network

Our products may depend on an internet or mobile connection to provide remote monitoring and control.

If the internet or mobile network is unavailable, the application may not be able to communicate with the equipment.

Depending on the system design, some automatic functions may continue operating locally, while other functions may not work until the connection is restored.

You are responsible for providing and maintaining any internet or mobile connection required for your service unless we have agreed otherwise.

18. Service Availability

We aim to provide reliable services, but we cannot promise that the application or connected services will always be available without interruption.

The service may sometimes be unavailable because of maintenance, internet problems, mobile network problems, power failures, equipment problems, weather conditions, third-party service problems or other circumstances outside our reasonable control.

We will make reasonable efforts to restore services when we become aware of problems affecting our systems.

19. Power Failures

Our systems require an appropriate power supply unless the particular product has been designed to operate using another power source.

If there is a power failure, the equipment may stop operating unless an appropriate backup power system is available.

The customer is responsible for providing suitable backup power where continuous operation is required.

20. Maintenance

Agricultural equipment requires regular maintenance.

Customers are responsible for keeping the equipment, sensors, pipes, pumps, fans, valves and other related equipment in suitable working condition unless maintenance is included in a separate service agreement.

Regular cleaning, inspection and replacement of worn or damaged parts may be necessary.

Failure to properly maintain the system may affect its performance and may also affect warranty coverage.

21. Repairs and Replacement

If equipment becomes damaged or stops working, we will assess the problem and determine whether it is covered by warranty or whether a repair or replacement charge applies.

Where a component needs to be replaced, we may use an equivalent component where the original component is no longer available.

Repair times may depend on the availability of spare parts, technician availability and the location of the installation.

22. Warranty

Products supplied by us may be covered by a warranty according to the warranty terms provided with the relevant product.

The warranty generally applies to manufacturing defects and other issues specifically covered by the applicable warranty.

The warranty may not cover damage caused by misuse, accidents, unauthorized modifications, unsuitable power supply, water damage caused by improper use, physical damage, improper installation by others, lack of maintenance, natural disasters or other circumstances outside the warranty terms.

The exact warranty period and conditions may vary between products.

23. Warranty Does Not Guarantee Agricultural Results

Our warranty covers the product according to the applicable warranty terms. It does not guarantee crop yield, crop quality, plant growth, drying results, water savings, nutrient performance or any other agricultural result.

Agricultural results depend on many factors outside our control.

24. Customer Changes and Modifications

Customers must not make unauthorized changes to our equipment or system.

Changing wiring, sensors, electrical connections, software settings or other parts of the system without appropriate authorization may cause damage or unsafe operation.

If unauthorized changes cause damage, we may charge for inspection, repair or replacement.

Such changes may also affect warranty coverage.

25. Payments

Customers are required to pay the agreed price for products and services according to the quotation, invoice or agreement provided by us.

Additional work, equipment, installation requirements or services not included in the original quotation may result in additional charges.

Where payment is overdue, we may suspend certain services after providing appropriate notice, subject to the applicable agreement and law.

26. Product Prices

Prices may vary depending on the product, equipment, installation requirements and selected services.

A quotation provided to a customer will normally describe the products and services included in that quotation.

Unless otherwise stated, additional work or equipment requested after the quotation may be charged separately.

27. Delivery

Delivery dates are estimates unless we have specifically agreed to a fixed delivery date in writing.

Delivery may be affected by product availability, transportation, supplier delays, customs, weather or other circumstances outside our reasonable control.

We will make reasonable efforts to inform customers about significant delays.

28. Cancellation

Cancellation of an order may be subject to the terms provided in the quotation, order confirmation or agreement.

Where equipment has already been specially purchased, manufactured, configured or installed for a customer, cancellation may result in charges for costs already incurred.

Any refund will be handled according to the applicable agreement and applicable law.

29. Customer Property

Customers remain responsible for their own crops, agricultural products, buildings, land, water sources, electrical systems and other property.

Our products are intended to assist with monitoring and automation but do not remove the customer's responsibility to protect their agricultural operation.

30. Agricultural Decisions

Our application provides information and automation features to assist customers with agricultural operations.

The customer remains responsible for deciding how to manage crops, irrigation, nutrients, drying, hydroponics and other agricultural activities.

We recommend obtaining professional agricultural advice where specialist advice is required.

31. Emergency Situations

Our systems should not be treated as an emergency safety system unless we have specifically stated in writing that a particular product is designed and certified for that purpose.

Customers should not depend solely on our application to protect people, animals, buildings, crops or valuable equipment from dangerous situations.

Appropriate safety systems and human supervision should be used where necessary.

32. Notifications and Alerts

Our application may send notifications about equipment conditions, agricultural measurements, system problems or other events.

Notifications depend on the application, internet connection, mobile network, device settings and other services.

We cannot guarantee that every notification will always arrive immediately.

You should not rely solely on notifications for situations where immediate action is required.

33. Use of the Application

You agree to use our application only for its intended purpose.

You must not intentionally misuse the application, attempt to access another customer's account, interfere with the service or use the application in a way that could damage our systems or affect other customers.

You must also not use our services for unlawful purposes.

34. Intellectual Property

The application, website, product designs, software, documentation, logos, brand names and other materials provided by us belong to us or our relevant partners unless stated otherwise.

Using our products does not give you ownership of these materials.

You may use the application and other materials only for the purpose for which they are provided to you.

35. Customer Data

Information relating to your agricultural operation belongs to you or your organization, subject to any separate agreement between you and us.

We use this information to provide and improve our services.

We will handle personal information according to our Privacy Policy.

36. Privacy

Our collection and use of personal information is explained in our Privacy Policy.

By using our services, you should also review and understand our Privacy Policy, which explains how we handle information such as your name, contact details, account information, device information and location information.

The Privacy Policy forms an important part of your relationship with us.

37. Third-Party Services

Some features of our products may depend on services provided by other companies, such as weather information, internet services, mobile networks, cloud services, mapping services or notification services.

We do not control all third-party services and therefore cannot guarantee that they will always be available or operate without interruption.

Where a problem with a third-party service affects our product, we will make reasonable efforts to restore or work around the problem where possible.

38. Changes to Our Products

We may improve, modify or update our products and services from time to time.

Changes may be made to improve performance, security, reliability or functionality.

Where a change significantly affects a service you have purchased, we will make reasonable efforts to provide appropriate information.

39. Suspension of Service

We may temporarily suspend access to a service when necessary for maintenance, security, serious technical problems or other reasonable reasons.

We may also suspend an account if there is serious misuse of the service, unauthorized access attempts, non-payment or another significant breach of these Terms and Conditions, subject to applicable law.

40. Ending the Service

You may stop using our services according to the terms of your agreement with us.

If you have an ongoing subscription or service agreement, cancellation may be subject to the conditions of that agreement.

When a service ends, certain information may continue to be retained for legitimate business, legal, warranty or accounting purposes.

41. Limitation of Responsibility

We provide our products and services to assist customers with agricultural monitoring and management.

We are not responsible for losses that result from circumstances outside our reasonable control, including power failures, internet failures, mobile network problems, extreme weather, floods, fires, natural disasters, unauthorized changes, improper maintenance, misuse of equipment or problems with third-party services.

We also do not guarantee specific agricultural results, crop yields, drying results, water savings or plant growth.

Nothing in these Terms and Conditions is intended to exclude any responsibility that cannot legally be excluded under applicable law.

42. Customer Responsibility for Monitoring

Even when an agricultural system is operating automatically, customers should regularly check their agricultural operation and equipment.

Automation is intended to reduce manual work and assist with monitoring. It does not mean that the customer no longer needs to inspect the farm, greenhouse, dryer, irrigation system or other agricultural equipment.

43. Technical Support

We may provide support through telephone, email, messaging services, remote assistance or on-site visits, depending on the service purchased.

Support availability and response times may vary depending on the product and service agreement.

Where a problem is caused by equipment outside our system, an internet connection, electrical supply, water supply or another third party, additional charges may apply where applicable.

44. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our products, services, business practices or legal requirements.

When we make important changes, we may provide notice through our application, website, email or another appropriate method.

The latest version will include the updated date at the beginning of this document.

45. Applicable Law

These Terms and Conditions are intended to be governed by the laws of the Democratic Socialist Republic of Sri Lanka.

Any dispute relating to our products or services will be handled according to the applicable laws and agreements between the customer and the Company.

47. Customer Agreement

By purchasing our products, accepting a quotation, creating an account, installing our application or using our products and services, you confirm that you have had an opportunity to read and understand these Terms and Conditions.

If you are accepting these Terms and Conditions on behalf of a company, farm or organization, you confirm that you have the authority to do so.

If you do not agree with these Terms and Conditions, please contact us before purchasing or using the relevant product or service.
